    Following a landmark case between a borrower and lender, evidence has confirmed the fears of many homeowners in financial distress; lenders are selling repossessed property for less than they are worth. This is exasperating the difficult financial position of borrowers who find themselves in financial difficulty.

    Repossession figures are currently 3,000 a month, and it is rising.Generally, the lender will sell a repossessed property, and the borrower owes the shortfall. The figures are rarely challenged, even though lenders can chase this debt for up to 15 years.
    Although the lender is supposed to be acting in the interest of the borrower to get the best price offered, they are also under pressure to offload properties that are a financial liability on their books, and therefore want to sell ASAP. The longer a property is on the market, the greater the debt due to missed payments with interest and other expenses also accumulating.

    I deal with lots of landlords in similar situations, who have found themselves in financial distress either due to portfolio mismanagement or external influences such as redundancy, tenants missing payments or failure of their business.
